A foreign national married to a Spanish citizen may apply for nationality by residence after one year of legal, continuous residence immediately before the application, provided the applicant has also been married for at least one year and is not legally or de facto separated. The applicant must demonstrate good civic conduct and integration, generally through the CCSE and DELE A2 examinations, subject to exemptions. A registered domestic partnership does not meet the statutory spouse category.
The one-year residence period and one-year marriage period are separate cumulative conditions. Residence must be legal, continuous and immediately before the application. At application, the marriage must not be legally or de facto separated. Renunciation is declared at acquisition except for nationals of Ibero-American countries, Andorra, the Philippines, Equatorial Guinea, Portugal, and Spanish-origin Sephardim. The application is made through the Ministry of Justice; the consulates do not process nationality by residence.
